Etree.org welcomes lovers of all types of music. We support the discussion
and trading of the highest quality recordings of:
- live performances;
- by bands/performers that allow taping and trading;
- in a lossless compression format.
Many bands are very clear in their support of taping and trading: Grateful
Dead, Phish and Dave Matthews Band, for example, all have written policies
on taping and trading.
http://www.etree.org/thebands.html has information
on many other taper-friendly bands. There are also links on that page to
other information on bands that allow taping and trading. You may use the
appropriate etree.org mailing list to discuss any band or performer that allows
taping and trading.
Conversely, there are performers who are notoriously against taping and
trading (Bob Dylan and Live, to name only two). You may not use the
etree.org mailing lists to discuss such artists. Solicitations to exchange music by
these artists are prohibited and will not be tolerated.
There will always be performers whose views on taping and trading are
unknown, or unclear. If you would like to trade music by such a performer,
it is up to you to demonstrate to the Server Team that the person or band at
issue does indeed allow trading. In other words, if you offer to trade
music by someone who is questionable, we will ask you to refrain from doing
so -- until you can show us that it is OK.
Finally, so-called liberated bootlegs -- CDs that were not officially
released by the band, but rather were pressed by an unauthorized company --
are subject to the same test: If the liberated bootleg is of a performer
that allows trading, you may discuss it on etree.org lists; if the liberated
bootleg is of someone who is anti-trading [or we're not clear on their
trading stance], you may not.

etree.org | zero-tollerance policy against bootleggers

Etree.org is a community of music fans that freely trade and distribute the
music of bands that allow the audio taping of their live performances. As a
community, etree.org condemns anyone that sells or
attempts to sell the music available via etree.org.
Etree.org maintains a zero-tolerance policy towards any persons selling music
distributed by etree.org or the selling of any original copyrighted CD jewel
case artwork that is made available on the etree.org website or associated file (FTP)
servers.
The etree.org community maintains a steady vigil against people that try to profit
from the selling of discs by:
- Closely monitoring online auction houses
(eBay,
Yahoo!® Auctions and
Amazon.com Auctions).
- Blocking the IP address of known offenders from etree.org web and FTP servers.
- Removing and banning known offenders from all etree.org mailing lists.
All instances of bootleg selling should be reported to the appropriate authorities.
Please do not take matters into your own hands! The etree.org community has had a
wonderful success rate of getting such auctions removed by using the following resources:

This privacy statement is applicable to etree.org, as operated by the etree organization's community of volunteers.
The privacy of the users of the etree organization's web site, mailing lists,
and FTP servers is very important. Etree.org does not collect personally identifiable
information about website visitors except when individuals specifically provide such
information on a voluntary basis. This personally identifiable information may be
typically gathered from community postings (etree.org mailing lists), suggestion and
voting/polling areas, and message boards. Personally identifiable information on
individual users will not be sold or otherwise transferred to unaffiliated third parties,
except when specifically noted (for example, when voting for etree.org in external polls,
which may be linked to from the etree.org website or mailing lists).
Etree.org reserves the right to perform statistical analyses of user behavior and
characteristics in order to measure interest in and use of the various areas of our
website, but will never share this information with third parties.
If you are under 13 years of age, you should not provide any personally identifiable
information on this site without the knowledge and permission of your parent or guardian. If we learn
that you are under 13 years of age, we will not maintain or use any personally identifiable information
about you without the verifiable consent of your parent or guardian, except as allowed by law. This may
mean that you will be unable to participate in some activities on etree.org without such verifiable consent.
The foregoing policies are effective August 1, 1999. Etree.org reserves the right
to change this policy at any time by notifying the community members of the existence
of a new privacy statement via this website and through the etree.org mailing lists.

spirit of etree.org, and must be in a non-commercial manner, outlined below:
The logo usage must be in a not-for-profit manner.
Alterations to any of the etree.org logos must be with
prior permission only! The only exception is necessary resizing.
When linking to etree.org or referring to the etree.org community in the media, please
let us know!. We like to know who is talking about us,
and are maintaining an etree.org media archive.
- Etree.org reserves the right to have final say over how it's logos and/or service

Etree.org complies with Phish's taping and digital transfer policy. Please read the following statement:
Official Statement from http://www.phish.com
All taping must be for personal use only, which may include trading
(via analog or digital tape, CD, or digital file transfer). Recordings may be traded
only for an equivalent amount of similar media (cassettes or CDs, pre-recorded or
blank). Regardless of any expenses incurred, no money may ever be exchanged as part
of a trade; however, stamped, self-addressed envelopes may be included with blank
media. In addition, the mediums by which audio trading is publicized may not be
commercialized. Therefore newsletters, web sites, clubs, or any other communication
forum facilitating audio trading cannot accept advertising, offer links for
compensation, exploit databases compiled from their traffic, or otherwise derive
any commercial profit in any form. Stores or businesses may not offer to duplicate
Phish media for customers or sell or otherwise provide media containing unreleased
Phish music for any price. A statement of compliance with this policy must be clearly
posted on all web sites engaged in trading activity.
If we have chosen to offer for sale (via physical media such as CD,
or via digital download) a particular Phish performance, this "official"
version will take precedence over amateur recordings being offered for download.
In these instances, we require that digital audio repositories remove any recording
of these particular performances from their collections within 3 days of the official
release or 3 days of Phish announcing the intention to release, whichever is earlier.
Notwithstanding the above, Phish reserves the right to require immediate removal of
any unreleased Phish material. It is the responsibility of the site host to remain
informed of the current list of Phish's officially-released recordings and to maintain
their site accordingly. In no case may any officially-released Phish recording (live
or studio) be duplicated or otherwise traded or offered. Broadcast of unreleased
Phish recordings via: radio or online is permissible only if it conforms to all the
guidelines applicable to other forms of duplication.
Audience taping at Phish concerts is authorized for non-commercial
purposes only. Unauthorized sale, duplication and/or distribution is strictly
forbidden. All Phish performances and recordings are the exclusive property of Phish.
All rights reserved. The rights to record Phish performances set forth in this policy
constitute an express, revocable license. We reserve the right to withdraw our
sanction of recording, tape trading, and/or non-commercial digital audio file
transfers on a case specific basis or in general, as we deem necessary. No waiver
of any copyright or trademark right is intended.

Please read the following statement:
Message from Grateful Dead Productions, Inc. // Ice Nine
STATEMENT TO MP3 SITE OPERATORS:
The Grateful Dead and our managing organizations have long encouraged
the purely non-commercial exchange of music taped at our concerts and those of our
individual members. That a new medium of distribution has arisen - digital audio
files being traded over the Internet - does not change our policy in this regard.
Our stipulations regarding digital distribution are merely extensions
of those long-standing principles and they are as follows:
No commercial gain may be sought by websites offering digital
files of our music, whether through advertising, exploiting databases compiled
from their traffic, or any other means.
All participants in such digital exchange acknowledge and respect
the copyrights of the performers, writers and publishers of the music.
This notice should be clearly posted on all sites engaged in this
activity.
We reserve the ability to withdraw our sanction of non-commercial
digital music should circumstances arise that compromise our ability to protect and
steward the integrity of our work.
